can we bill code 99446 from our doctor to insurance doctor or any other doctor? or ma /pa

These codes are intended for use with insurance, claiming time spent on patient care. Physicians are ethically and legally obligated to disclose medical information to a treating physician with informed consent, however, this time spent can be reported by the treating physician for reimbursement by the payer. NOTE: Be sure to contact the payer to ensure the payer policy allows payment for services such as consultations, many payers will not pay for consults.

Other considerations
Medical Record FEES: Each State has its own rules based on each state’s legislation for medical record copying fees, refer to your state for a reasonable cost-base fee for time spent.
HIPAA laws may also differ state to state, be sure to visit HHS.gov for any HIPAA rules that may apply.
