billing e&m code & out pt sx same day

Dr saw a patient on call in the ER, evaluated her & decided she needed op sx for an ectopic pregnancy. Can I bill an E&M code for the initial visit in ER & bill the surgery that was done later that day? Are there any modifiers? Thank you, Kathy
