CPT® 45380 and modifier 76

Can anyone help me with this rejection. The surgeon had to do a repeat procedure. I have used the modifier 76 and it has been rejected by Medicare saying that it is missing a required modifier or the modifier used in inconsistent.

Well that is what I thought. However, looking at it again it was billed the first time with CPT® 45384 and then 45380-76. It looks like I need to have both CPT® the same to use modifier 76. Would you agree with that?

Yes the CPT's should be the same. Otherwise you would need modifier 59.

I believe you need to add 76 with 59.
