Modifer 58

We saw our patient in hospital due to hemorrage from the throat I billed
99213 POS 22 and mod 58 because patient had surgery on 2-7-13. However, you must know that we have two physicians in our practice under same tax id. DR. R performed the surgery but Dr. O saw the patient for the hemmorage because he was on call. Mercy Care denied stating "inconsistant modifer used or missing" I thought about using a mod 24 but that states that it is not related to surgery. Patient is in post op period and the hemmorage is due to surgery. I have a two part question.

1. Did I bill correctly since I can't use consults for this insurance? I used a est patient 99213 with POS 22, is the place of service correct?

2. What modifer do i use for seeing the patient in hospital within post op and reason is related to surgery?
