biling a New Patient charge

I know in order to bill MC for a "new patient" charge the physician may not have seen the patient for 3 years. Is this true of commercial insurance as well?

If they follow AMA/CPT® guidelines, yes. See the beginning of the E&M section of the CPT® book, "New and Established Patient". And, new/different diagnosis makes no difference.
