TCM in Assisted living with employed staff

I takecare of residents in a Assited Living and there is an employed NP at the facility (their employee who sees residents and bills for the facilty, not me but I have collaborative agreement over and supervise the care the NP delivers). Can their visit count as the 1st E/M visit within the 7 or 14 day time frame when I Bill the TCM at the end of 30days or must I perform the 7 day face to face visit.

And can the staff at the assisted living who coordinate the patients return, meaning their RN who processes meds and takes care of scripts same day patient returns from hospital - can that count toward my making contact within 48 hours. I supervise and manage the care of all these residents at the PCP with the assistance that the facility who provides iwth it's RN, staff, and NPs. While it's not my employed staff, they operate in coordination with me.

You can never bill for services under your provider number that are performed by someone who is not an expense to you.

This NP working for the assisted living facility may not perform any of the components of TCM that you are going to count as part of your service to meet the requirements to bill .
