Billing for Pre Op when surgery is postponed

Can a surgeon bill an E/M for the Pre Op if the patient schedules the surgery, comes in for their pre op with the surgeon and then reschedules the surgery for 5 weeks later? The surgeon brought the patient back for another pre op 30 days after the first pre op.

It probably would depend on the documentation for the visit. the question I'd ask when I reviewed the chart is, if the surgery never existed, would that note be able to be supported as a medically necessary problem focused visit. I'd look at the medical decision making and see if I could support that. So if the MDM was based around final surgery instructions/prep, I'd be inclined not to support it.
