Modifier 79

Dr performed a carpal tunnel release on the left hand. 7 weeks later the Dr performed a carpal tunnel release on the right hand. Considering that the diagnosis is the same and it is during the global period would the appropriate modifier be 79 (unrelated procedure or service by the same physician during the post operative period) or would 76 (repeat procedure or serice by same physician or other qualified healthcare professional)?

I am leaning to modifier 76 because the ICD-9 and the CPT® codes are all the same just different hands.

I have always used -79 as even though it is the same procedure, it is being performed on a different extremity. Make sure you add your -RT & -LT modifiers on each carpal tunnel as well.

79 would be the proper modifier. The procedure on the left hand and right hand are not related to one another. They are independent procedures that are medically not related. The condition of the left hand did not cause the condition in the right.
