Can a dentist be "incident to" a physician?

We are wanting a dentist to join our ENT practice to do a specialized service (E0486-Oral device/appliance used to reduce upper airway collapsibility, adjustable or non-adjustable, custom fabricated, includes fitting and
adjustment) for our sleep apnea patients. Our PPO's will not credential a dentist. Could a dentist be considered a "NPP" in an "incident to" rule so that we could bill under our ENT provider #?

You won't find this specifically answered in the manuals, but I believe that CMS has said that MD's cannot be billed incident to.

It might be best to consult a lawyer, or your regional CMS office for this one.
