E/M code w/25 and 96372

This is a continuing debate in our office, and the majority opinion seems to change often. Can you, or can you not, add the 25 modifier to the E/M code and bill the injection code?

Example: Patient in for sinus infection: 99213-25
Kenalog injection given: J-----
Admin 96372

If so, is there ever an instance when this would be incorrect?

I say yes, in circumstances where the injection is the result of the history and exam (essentially part of the MDM). Not when the patient comes in with the expectation of getting the injection.

In my mind, if Medicare never intended to pay for 96372 with an E/M, then it would not allow it to bypass CCI, but it does. Other payers may have different policies of course. And you wouldn't bill it with 99211.
