When doing tobacco cessation, can an RN do this and we bill for it? codes 99406 and 99407

I have heard consultants say it can be billed as incident to, and then, yes a nurse can do it.

I am not so sure: is it in the nurse's scope of practice in your state? I always considered it a provider service and don't know of anything in writing from Medicare that allows it.
