Hospital Based Clinics & NPs

I need clarification, our Ohio clinic office is now hospital based and the NPs are now employeed by the hospital. Our doctors are seeing patients at the Hospital based clinic and the note is signed by both the physician and the NP and I'm seeing this statement being documented: Pt. seen & examined by nurse practitioner with Dr. Jones. Plan was discussed with Dr. Jones and patient. The services are being billed under Dr. Jones; both the MD and the NP are having a face-to-face visit with the patient. Am I correct that since the NP is employeed by the hospital that these services can not be billed incident-to?

Incident to is not applicable if the NP is employed by the hospital. The doctor can only bill for services that he/she personally provides. If the NP is credentialed by the payer, claim should be billed under NP #. If billed under doctor, documentation must be explicit that the physician was actively involved in management and medical decision making.
Some hospital systems have further restrictions on mid-level providers. Examples: may require physician to write/sign all prescriptions; may require physician to sign off on all notes written by mid-level.
If encounter meets for shared visit, can be billed under physician, but documentation must clearly indicate physician management/involvement.
