New/Established patient billing in Anesthesia Spine/Pain Clinic

If a patient is seen by an anesthesiologist during an operative procedure then comes to the spine/pain clinic two years later for an office visit and is seen by a pain physician in the same anesthesia department, should this patient be categorized as a new or established patient? I have a system that is hitting an edit and stating that my patient is established. I would consider them new because when seen for OR anesthesia, the patient is not billed an E/M code but they are billed the anesthesia procedural code.

If you have rendered a professional service (face-face) within 3 years, it is an established patient in your office.
