Laser photoresection following bronch, no indication if same doc, same day.

Doc did laser photoresection of bronchial lesions following "previous" bronch suspicious for CA in situ, did not indicate same day but obviously different encounter in same day surgery. Modifier 59? Re-read all guidelines and rules but confused a bit still with rules about that. Can anyone clarify rules any more?
