New & established patient visits in skilled nursing home

If a current patient of our practice resides in a LTC facility & recently is moved to skilled nursing due to a surgery and we are asked to see patient, can we bill new patient visit since the patient is in a different facility OR do we stick to the not seen on 3 years rule? Supposedly one of my docs was told he can bill as new patient & i cannot find evidence of this.
