Late calls through emergency room

Patient presents to ER @ 1:00 a.m. Physician Assistant sees patient at that time and dictates his note. The supervising Doctor sees them on rounds at 7:30 a.m. that same morning and he also examines patient and dictates note. Can you bill a late call and the ER visit and use the Supervising Doctor. 99283 and 99053 with supervising Dr. and not PA.

You cannot use a "late call" code. The ED is licensed to be a 24 hour facility

Our group is not employed by the hospital so we bill separately from them. Does this make a difference if we can bill a late call.
