Laparscopic repair, inguinal hernia, incarcerated

We selected to use 49659 unlisted and the inusrance company is suggesting we use 49650. Since 49650 does not include incarcerated, what would be the correct code to use? I see there was a posting similar to this but provided no rationale. Can someone please provide some clarity along with the rationale? Thanks for helping!
