Can I bill without patient present?

Patient is minor-patient not present for office visit. Only Mom and Dad are present. Can I bill and OV? No exam was performed.

In our office, we don't bill family conference. E/M codes are face to face encounter. We only bill O/V if patient is accompanied by family member. Doc still has to create a chart for the visit.

I believe that Medicare requires patient to be present but that other payers will pay a 99211 if parents receive a service for the child such as picking up a prescription for ADD and the like. If this is not correct, I would like to know the source the opposing opinion is derived from.

I know of no insurer who allows for charging to pick up Rx and pays for same
