New patient physical and e/m code (99214)

I am doing an audit of one of our Nurse practitioners. She saw a new patient and in her HPI she very briefly mentions an ongoing problem and some chronic issues. I'm not sure how to go about coding this. My opinion is that since this is a new patient all his chronic issues are all patient history. I could only see adding the additional e/m service if there is an acute issue or a change in the patients treatment plan d/t ineffectiveness of the patients current treatment regime from his previous MD.

I would like some clarification on this subject.

A detailed exam (99214) requires a detailed history or detailed physical based on medical necessity and moderate complexity MDM. If the chronic conditions are managed during the encounter could satisfy an extended HPI based on 3 or more chronic conditions.
