Dialysis and E/M on Same DOS

A nephrologist bills his code for his monthly capitation payment on the 1st of Sept on a patient that is currently in the hospital as an inpatient. He rounds on the patient and bills for a subsequent hospital visit on the same day (Sept. 1). Can he bill for both services if he appends a 25 modifier on the subsequent hospital code?

If the patient is hospitalized during a month for a nondialysis-related or dialysis-related reason, the renal physician can choose to continue to bill a full monthly capitation fee or less than a full month of monthly capitation fee and the appropriate inpatient hospital services.
