incident-to in clinic setting

CMS's incident-to guidelines address incident to services provided in a clinic (IOM #100-02 Chapter 15, section 60.3) stating, "Services and supplies incident to a physician’s service in a physician directed clinic or group association are generally the same as those described above." (the office setting)

How do I determine if a clinic located within a hospital is an appropriate place of service for incident-to services?

Outpatient

A clinic within the hospital is usually outpatient hospital site of service and there is no "incident to" because the physician does not pay for practice expenses, overhead. Only applies to the office or clinic (not in hospitals or nursing facilities)
