Global billing

I have a patient that had a surgery on 06/22/2012 and then on 09/17/2012 had her Annual Pap Smear done. The insurance is denying the 99396 for falling under the global umbrella of the June surgery. I have had 2 calls and 4 different people tell me that it doesn't matter that it is her Annual it was billed within 90 days of the surgery. This is a first for me!!

Is there anything I can do to get the Annual paid for???

Append modifier -24 to the annual exam. UNRELATED EVALUATION AND MANAGEMENT SERVICE BY THE SAME PHYSICIAN DURING A POSTOPERATIVE PERIOD: The physician may need to indicate that an evaluation and management service was performed during a postoperative period for a reason(s) unrelated to the original procedure. This circumstance may be reported by adding modifier 24 to the appropriate level of E/M service.
