consult vs follow up

We have a NP that saw a new patient and billed a 99245. I know that the NP can not bill for a consult, BUT in the last statement of this note it states...

Dr. X was in to see the patient today with me, examined him himself, and is in agreement with me on his plan of care.

Question is- can we use this statement as the dr was there, doing the exam, so we can now bill as a consult?

or..

If we can not bill this as a consult- can we bill as a 99215 even though the patient was never seen in our practice before?

consult by NPP

Take a look at the articles on shared services (an NPP and an MD may not each provide part of a consult and bill under the MD's provider number. )

If you type in the words "shared services" in the search box above "Look it up" the first three articles will answer your questions.

Bill the consult under the MD's provider number, basing your level of service ONLY on what the MD has documented.

Alternatively, bill with the unlisted code, 99499.
