Incident to billing by time

Hi,

I am looking for instructions or rules about billing a genetic counseling session as incident to with E&M codes by time.

Apparently in Iowa a genetic counselor is not recognized as a billing provider so we cannot submit 96040 for the counselor. We are looking at billing for an E&M code by time and incident to one of our providers who would be there to provide the supervision. The counseling would be part of a plan documented by a billing provider.
