ER Consult with subsequent IP admission - Medicare

Please confirm if the below is the correct interpretation of the Medicare’s guidelines regarding how to code the Medicare “consult” when performed in the ER?

Since Medicare no longer pays for consult services, the "consult" would be billed as either:
1. an admission H&P (99221-99223) with -AI (if the consultant admits the patient as an inpatient to his or her own service),
2. as admission H&P (99221-99223) without AI modifier (if patient is seen in the ER but being admitted as inpatient on another service (eg., admitted by Hospitalist)
3. as a new or established office visit (99201-99205 or 99212-99215), if the patient is being admitted under observation status (eg., admitted by either you or by another physician)
4. as an ER visit (99281-99285) (if the patient is sent home from the ER)

The guidelines seem to state that you pick the code based on the location of the patient at the time of the consult.
So for Medicare (who does not accept the consult codes), if your consult is performed in the ER, but the patient is subsequently admitted by the Hospitalist (not you), would you bill an ER code or would you bill an initial hospital code (99221 - 99223) without the -AI modifier?

The guidelines are not very clear in this scenario. The examples they provide are either when you consult in the ER then you admit.
Or you consult in the ER and the patient is discharged.
What happens when you consult in the ER and a different provider subsequently admits?
You could argue that the patient's status at the time of your consult was registered to the ER, therefore you should bill an ER code....
or you could argue that if the patient is subsequently admitted by a different provider your ER consult should roll into the IP status since that is where the patient ends up … are we required to verify when the order to admit was entered or can we just use the DOS to determine the status of the patient at the time of the consult?
