Am I able to charge a preventative visit and a problem visit on the same claim using a 25 modifier? the provider is writing separate progress notes.

Yes, modifier 25 needs to be on the problem E&M code (NEVER on the preventative service) and the dx code needs to be a 'problem dx' (i.e. not a v-code). The documentation has to support the service was separate and identifiable from the prev. service.

To clarify and avoid confusion you NEVER add the 25 mod to a preventative visit, when billed with another E&M code. If the prev visit is the ONLY E&M code and there is also a procedure, injection (admin codes), etc. then you would attach the modifier to the prev visit.
