Discontinued Procedure

Our physician was supposed to place a peritoneal dialysis catheter. When he performed the laparoscopy he encountered a large amount of serosangiuoneous ascitic fluid, and also a very large abnormal looking ovarian mass. He had aspirated the peritoneal fluid, and decided not to place the PD cath because he was concerned that the the ovarian mass is malignant. I had billed 49322, should I bill 49324 with a modifier 53 as well? I would appreciate any input on this issue.
