Medical Resident billing

I work for a Federally Qualified Health Care organization ( a community health center) and we have medical residents who come to our clinics to provide care to our patients. These residents are actually employed by a local teaching hospital and covered under the GME. The hospital pays us 100.00 a day per resident. My question is - is it legal for us to bill Medicare, Medicaid and TPA's for the resident's services under incident to billing guidelines? or, is this considered fraud? any information, references, websites, etc will be greatly appreciated.
