Same Dx for Flu Swab and E/M

Can I use the same diagnosis codes when billing 87804, 87804-59 (since we are testing for A&B strains-non Medicare) and 99213? My boss keeps telling me I HAVE to use modidifer 25 with the E/M and have different Dx codes. All the Dx codes that are being used are related to flu symptoms.

You will need a 25 modifier with the E/M code. Yes, you can use the same DX for the E/m and flu test. Depending on the test brand that you use for your flu test depends on how you will bill for that.
