modifier for specialist seeing a patient in hospital

Our Dr saw a patient in the hospital for a consultation, and another Dr of the same speciality did a consultation for the same patient on the same day. I tried modifier 77 and 27 and both got denied. Which modifier am I supposed to use to get this claim paid?

Again, medical necessity was probably not established for having 2 doctors of same specialty performing a consultation on same patient, same day. If same specialty/same diagnosis code(s)--you have a problem.

Same day services are typically not covered in addition, modifier -77 would not be appropiate as it cannot be appended to E/M services. Modifier 27 Multiple Outpatient Hospital E/M Encounters on the Same Day (Not required by CMS and not to be used by physicians for reporting of multiple E/M services).

our Dr is an on call Dr for this hospital. So we will be penalized for this claim?
