medicare guideline on E/M

Does anyone know of a guideline that says you can use a patient's PMH and or PSH when there is no ROS listed in an outpatient note? We are being told that you can pick out diagnosis from these and convert it into the ROS. To me this seems fraudulent in order to score a higher e/m level.
