New Patient or Established

I need to clarify what is a New pt and what is a Established pt....

If a pt is seen by a physician on a regular basis for the same problem then comes in with a New problem, can the physician charge a New pt visit since it is a "New problem"? Or would this fall under the 3 year rule?
