Provider Based Facility Fee

Can a Medical Assistant charge a facility fee in a provider based clinic or does the level of medical support staff need to be a LPN or RN? The clinics have a point system in place to support the level of care (or facility fee) charged, so the Medical Assistant would only charge a facility fee equal to the scope of services that he or she provides (based on points). CMS does clarify was level of degree that the clinical support staff must have in a provider based clinic.
