Global Period Phlebectomy for Vein office

We do phlebectomies 37765 / 37766 and they have a 90 day global period. Most patient need them done bilateral. Many offices are doing for instance a RT leg on 01/01/xx then the LT leg on 01/14/xx. The arguement is which modifier should be used...79 unrelated or 58 as related? Please give any and all advice. Thanks!

I would say it's related because same condition. 58 is planned prospectively or at the time of the original procedure. My opinion try the 58 first and if the payers don't like it then use 79. Both should allow payment. If, you want to be safe throw in the LT as well don't be afraid to waste ink.
