Can the new add-on code 90791 be used with an E&M code only, not in conjuction with a counseling code?
Also:
Can new add-on code 90785 be billed together with 99202-99203 E&M code for initial visit?

A distinction has been made between an initial evaluation with medical services done by a physician (90792) and an initial evaluation done by a non-physician (90791). The evaluation codes 90791 and 90792 (with medical) can be reported by separate providers. Any deviation would be a result of individual payer policy. 90801 and 90802 will be replaced by 1 of 2 E/M codes: 90791 will be used for the psychiatric diagnosis evaluation without a medical evaluation provided by any mental health provider.
90792 will be used for the psychiatric diagnosis evaluation provided by a physician and including medical services, such as lab evaluation, prescriptions, etc.
These codes (90791 and 90792) can only be used once per day. They can’t be reported with E/M code on the same day by the same provider. They can’t be reported with psychotherapy service codes on the same day.
The add-on code +90785 has been added to designate "interactive complexity" when communication factors may complicate delivery of a psychiatric procedure. Interactive complexity can be used with:
• Initial evaluation codes (90791 and 90792)
• Psychotherapy codes
• Non-family group psychotherapy codes
• E/M codes when used in conjunction with psychotherapy services
