vasectomy ?

We have a Family practice doctor that does the vasectomy's for our practice. We are a multi specialty practice. The patient sees another one of our Family practice doctors and was referred over to the one that does vasectomy's. Anyway when the referrals are put thru they are put thru as "urology". Is it ok for the family practice doctor to charge a "new patient" since the referrals are specified as urology not family practice and he has not seen the patient before?

If the patient has been seen at a clinic/practice with the SAME tax ID within 3 years they are NOT a new patient.
