audits by private insurance companies

I recently took a CME course on outpatient coding. It primarily looked at the 1995 CMS quidelines, since they were considered to be in our favor compared to the 1997 guidelines. If we are audited by madicaid, we can choose to be audited by those guidlines. I practice in Massachusetts. If I am audited by a private insurance company, can I requested to be audited by the 1995 CMS Guidelines?

It is a Medicare standard that you can use either set, whichever is better for the physician/NP/PA. In my experience, private payers follow this, although I don't think there is a law.

CPT® doesn't really speak to it.
