patient on parole living in a rehab facility

Medicare took back a payemnt from 2011, stating the patient was incarcerated at the time of service, when in fact the patient was on parole living in a rehab facility. Medicare had taken the payment back, can we bill the facility for the 2011 DOS?

My experience with this scenario has been that as long as the person is incarcerated, the prison system is responsible for healthcare costs. You will likely need to obtain written documentation from the prison system as to the dates of incarceration, date of release to parole status and when their responsibility for healthcare needs expired. Medicare will require this documentation to reconsider the claim. I contacted the warden where the person was incarcerated. Possibly the parole officer to whom the parolee is currently assigned.
