Observation status to acute care

When a pt. was admitted to the hospital in observation status, and then after 2 days, changed to acute care, can we charge a discharge from observtion and an admit to acute care on the same day with a modifer? or would the whole stay be acute care? Thank you Sue

First day 99218-99220, then second day as outpatient subsequent visit then you should bill the day of switch to Inpatient as a low level H&P but no bill discharge from Observation since the patient is not being discharged
