How can I bill for an office exam if patient was sent to ER

We have a patient that had her full examination by the doctor; but she got progressively worse as the appointment was ending. Typically, I know you cannot bill for an office exam if a patient is seen in the hospital on the same day - Can I bill or not?

I would bill the office visit with a 25 modifier.

We wouldn't bill for the OV if the mid-level or physician saw the Pt in the hospital.

No OV bill- the work is included in the H&P payment since the doc will not repeat the full Hx and PE since she just did it.
