ED Consultations

Can both an ED provider and a General Surgeon charge for Emergency Dept. Services on the same date of service?
My GS did a consult in the ED, the patients primary insurance is Medicare so I am trying to code a NP visit since we cannot charge a consult. My billing office is telling me he needs to charge an ED service.

if...

the patient was seen in the ED and sent home, use the ED codes. No limit to type or number of providers who can bill that as long as separate specialties.

When Medicare stopped paying consult codes, they instructed other MD's who see the patient in the ED to use ED codes.
